Privacy Policy

This Privacy Policy explains how Intergalactic Foods Corp, doing business as Positive Food Co. (“Positive,” “we,” “us”), collects, uses, and shares information when you visit positive.co or fill out one of our forms. It does not cover our separate ordering platforms, which have their own policies.
1. Information we collect
Information you give us
- Wholesale and sign-up forms: your name, business email, phone number, business or organization name, delivery address, type of account, your role, whether you order for multiple locations, and your answers to our short questions (for example, the products you’re interested in, your timeline, and how you heard about us).
- Contact form: your name, email, topic, and the message you send us.
- Store launch list: the email address you enter to be notified when our Glendale store opens.
Information collected automatically
- Usage data: pages viewed, referring page, browser and device type, and similar technical information, collected through Vercel Analytics and our own page-view counter. This data is aggregated and not used to identify you.
- Approximate location: our hosting provider may derive an approximate location (city or region) from your IP address. We don’t collect precise location.
- Browser storage: we store your light/dark display preference in your browser. If you’ve signed in to one of our ordering platforms, we may read a first-party cookie with your name and email to pre-fill our forms.
2. How we use information
- To review your inquiry, follow up with you, and set up your account or deliveries.
- To notify you when our store opens, if you asked us to.
- To answer questions and provide customer support.
- To understand how our site is used and improve it.
- To protect our site and business, prevent fraud, and comply with the law.
3. How we share information
We don’t sell your personal information. We share it only as follows:
- Service providers that help us run the site: Vercel (hosting and analytics), Resend (email delivery), and Google (address autocomplete and web fonts). They may use your information only to provide services to us.
- Affiliated brands under common ownership, such as Servus, when it helps us respond to your request.
- Legal and safety: when required by law or to protect the rights, property, or safety of Positive, our customers, or others.
- Business transfers: in connection with a merger, acquisition, or sale of assets.
4. Cookies and similar technologies
We use a small number of first-party cookies and browser storage for site functionality and preferences, and privacy-friendly analytics that don’t rely on cross-site tracking cookies. You can clear or block cookies and site data in your browser settings; parts of the site may work differently if you do.
5. Data retention
We keep form submissions for as long as needed to respond to you and manage our business relationship, plus a reasonable period afterward for legal, tax, and accounting purposes. Store launch emails are kept until the store opens and we’ve notified you, or until you ask us to remove you.
6. Your choices
- You can ask us to access, correct, or delete your personal information by emailing hello@positive.co.
- If we send you marketing email, it will include a way to unsubscribe.
- You can control cookies and site data through your browser.
7. California privacy notice
If you are a California resident, California law requires us to provide you with some additional information about how we collect, use, and share your “personal information” (as defined in the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA”)).
Personal information we collect
In the past 12 months, we have collected the following categories of personal information:
- Identifiers, such as your name, email address, phone number, and IP address.
- Customer records, such as your business name and delivery address.
- Professional information, such as your role and the organization you represent.
- Internet or other electronic network activity, such as pages viewed, referring page, and browser and device type.
- Approximate geolocation derived from your IP address (city or region, not precise location).
- Inferences and preferences, such as the products you’re interested in and your display preference.
We collect this information directly from you, automatically when you use our site, and from our affiliated ordering platforms if you’ve signed in to one of them. We don’t collect sensitive personal information as defined by the CCPA.
How we use and disclose it
We use each category for the business purposes described in Section 2. We disclose these categories to the service providers and affiliates described in Section 3 for those same purposes. We keep personal information for the periods described in Section 5.
No sale or sharing
We do not sell your personal information or share it for cross-context behavioral advertising, and we have not done so in the past 12 months. We do not knowingly sell or share the personal information of consumers under 16.
Your rights
Subject to certain exceptions, California residents have the right to:
- Know the categories and specific pieces of personal information we have collected about you, the sources, our purposes, and the categories of third parties we disclose it to.
- Delete personal information we have collected from you.
- Correct inaccurate personal information we hold about you.
- Opt out of the sale or sharing of personal information (we don’t sell or share it).
- Not be discriminated against for exercising any of these rights.
How to make a request
To exercise your rights, email hello@positive.co with the subject line “California Privacy Request.” We’ll need to verify your identity before completing a request, typically by matching the information you provide with information we already have. You may use an authorized agent to make a request on your behalf; we may ask for proof that the agent is authorized and ask you to verify your identity directly. We’ll respond within the time required by law, generally 45 days.
8. Security
We use reasonable safeguards, including encryption in transit (TLS), to protect your information. No method of transmission or storage is completely secure, so we can’t guarantee absolute security.
9. Children
Our site is intended for businesses and adults and is not directed to children under 13. We don’t knowingly collect personal information from children. If you believe a child has given us information, contact us and we’ll delete it.
10. Changes to this policy
We may update this policy from time to time. When we do, we’ll post the new version here and update the date above. Continued use of the site after changes means you accept the updated policy.
